Foodie Trailers Terms And Conditions

Last Updated: January 1, 2026

Welcome to FoodieTrailers. Before you explore what we have to offer, please take a moment to read through these Terms & Conditions. They exist to make sure both you and we are on the same page — so there are no surprises down the road. By accessing or using our website at foodietrailers.com, you agree to be bound by everything outlined here. If any part of these Terms doesn’t sit right with you, please do not use the site.

Please Note: Submitting a quote request or placing an order through our website is the beginning of a conversation — not a binding contract. No agreement for the manufacture or sale of any goods takes effect until both you and FoodieTrailers sign a separate written Custom Manufacturing and Sale of Goods Contract. That contract governs the actual build, delivery, and sale. If there is ever a conflict between these Terms and that contract, the contract takes precedence.

1. Use of Our Website

By using this website, you confirm that you are at least 18 years old, that you will use the site for lawful purposes only, and that you will not misuse, disrupt, or attempt to gain unauthorized access to any part of it.

The following are prohibited when using our website: impersonating FoodieTrailers or any of its employees, representatives, or affiliates; sending spam, junk mail, chain mail, or any unsolicited promotional material; using automated bots, spiders, or scraping tools to access or copy content from the site; attempting to attack, overburden, or interfere with the proper working of the website; uploading or transmitting viruses, malware, or any other harmful code; using the site in any way that violates applicable federal, state, or local laws.

We reserve the right to restrict or terminate access if these terms are violated.

2. Products & Services

FoodieTrailers specializes in the sale of food trailers, custom-built trailer solutions, and business consultation and support. All product descriptions, specifications, and pricing are subject to change without notice.

The inclusion or offering of any product or service on this website does not constitute an endorsement or guarantee of availability. We expressly reserve the right to correct any pricing errors at any time.

3. Quotes & Orders

Every trailer we build is unique, and so is every quote. Pricing on our site is customized based on your specific needs — we will work through the details with you before putting a number on the table. Quoted prices do not include applicable taxes or additional fees, which will be outlined when your contract is prepared.

All quotes are non-binding until confirmed in writing. Orders are only finalized upon receipt of a signed Custom Manufacturing and Sale of Goods Contract and any required deposit. Pricing may vary based on customization, materials, and market conditions.

4. Payments

All payment obligations are governed by your Custom Manufacturing and Sale of Goods Contract. A few things worth knowing upfront:

  • Advance Payments: A non-refundable deposit will likely be required before production begins to cover real costs incurred on your behalf.
  • Interim & Final Payments: Additional payments will follow at milestones defined in your contract.
  • Late Payments: If payments are late, interest, fees, or production delays may apply as outlined in your contract.
  • Pickup & Storage: If you fail to take possession of completed goods on time, storage fees and other remedies — including resale — may be triggered.

Payments are processed through a secure third-party provider. We accept bank transfer, cash, and check. We are not responsible for how that processor handles your billing information, but you represent and warrant that any payment method you use is legitimately yours.

5. Custom Builds & Specifications

Because every trailer is custom-built to your specifications, accuracy is everything. You are solely responsible for reviewing and confirming that all specifications you provide are complete, correct, and compliant with applicable regulations before production begins.

Once designs and specifications are approved, changes may result in additional costs, administrative fees, and delays to your production timeline. Any change order must be made in writing and accepted by FoodieTrailers before it takes effect. We are not responsible for errors that were approved by the customer.

FoodieTrailers does not independently verify whether your design meets permitting or regulatory requirements unless expressly agreed to in writing.

6. Cancellations

We do not offer buyer-initiated cancellations on orders placed through this website. FoodieTrailers reserves the right to cancel any order at our sole discretion — for example, in cases involving fraud, inaccuracies, or product unavailability.

If we cancel your order after an advance payment has been made, that advance payment is non-refundable, as it was applied toward expenses already incurred on your behalf.

7. Returns & Refunds

Due to the custom nature of our products, we do not offer general returns or refunds through this website. Completed or custom-built trailers are not eligible for return.

Any rights you have regarding nonconforming or defective goods — including how and when to report issues, what remedies are available, and what procedures to follow — are defined exclusively in your Custom Manufacturing and Sale of Goods Contract. Please read that contract carefully. It is your roadmap for resolving any concerns about the finished product.

8. Warranty

Any warranty that applies to your purchase exists solely within the terms of your Custom Manufacturing and Sale of Goods Contract. Please review that contract carefully for all applicable warranty provisions.

Except as stated in your contract, no other warranty, express or implied — including any implied warranty of merchantability or fitness for a particular purpose — shall apply to any goods sold through this website.

9. Compliance & Permits

Customers are solely responsible for ensuring compliance with all applicable local, state, and federal laws, rules, ordinances, and permitting requirements in any jurisdiction where they intend to operate. This includes obtaining all necessary health, safety, and business licenses.

FoodieTrailers may provide general guidance but does not guarantee regulatory approval or warrant that any trailer, as designed or specified by you, will meet the requirements of your jurisdiction. If inaccurate specs lead to compliance issues or added costs, that responsibility rests with you.

10. Delivery & Production Timelines

Any production or delivery timeline we provide — whether an estimate, projected completion date, or schedule — is informational only and is not binding on FoodieTrailers. Timelines can shift due to supply chain issues, material shortages, labor circumstances, force majeure events, or delays on your end such as late approvals or missing information.

Once your trailer is complete, you will need to arrange pickup from our location promptly upon confirmation. Uncollected trailers may be treated as abandoned and restocked at our discretion. Shipping costs and arrangements, where applicable, will be communicated during the order process.

FoodieTrailers is not liable for damages caused by production or delivery delays except as expressly provided in your Custom Manufacturing and Sale of Goods Contract.

11. Intellectual Property & Confidentiality

All content on this website — including logos, text, graphics, images, and designs — is the property of FoodieTrailers or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any website content without our written permission.

Designs, plans, drawings, and specifications developed by FoodieTrailers in connection with your project remain our intellectual property unless we expressly agree otherwise in writing. You’re welcome to use the finished trailer — but the underlying designs stay with us.

Any confidential or proprietary information shared with you during the quoting or ordering process — including pricing, technical data, and business information — must be kept strictly confidential and may not be disclosed to third parties. These obligations survive the end of your relationship with us.

DMCA & Infringement Claims: If you believe in good faith that content on our website infringes your intellectual property rights, please send a written notice titled “Infringement of Intellectual Property Rights – DMCA” to team@foodietrailers.com. Your notice must include: a description of the work claimed to be infringed, the URL where it appears, your contact information, and a signed statement of good faith belief. Misrepresentation may expose you to liability for costs and attorneys’ fees.

12. Third-Party Links & Financing Tools

Our website may include links to third-party sites and financing platforms for your convenience. These services are operated independently, and their own terms and privacy policies apply. FoodieTrailers does not control, endorse, or accept liability for any third-party platform — including how they handle your data or the outcome of any financing application.

It is your responsibility to take precautions to ensure that any software or links you access are free of viruses and other harmful items.

13. Limitation of Liability

This website is provided “as is” without warranties of any kind. We do our best to keep information accurate and up to date, but we cannot guarantee it at all times.

To the fullest extent permitted by law, FoodieTrailers shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of — or inability to use — this website or any goods or services obtained through it, including business losses, lost profits, improper use or modification of the trailer, or failure to comply with local regulations. If FoodieTrailers is found liable for any direct loss or damage, our total liability is capped at the fees you have actually paid to FoodieTrailers in connection with the relevant transaction.

14. Indemnification

You agree to defend and hold FoodieTrailers harmless from any claims, losses, damages, or legal costs arising from: your misuse of our website or any goods obtained through it; your violation of any applicable law or third-party right; your submission of inaccurate, incomplete, or non-compliant specifications; your breach of these Terms or your Custom Manufacturing and Sale of Goods Contract.

15. Force Majeure

Events outside our reasonable control — including natural disasters, pandemics, supply chain disruptions, labor stoppages, governmental restrictions, or other unforeseeable circumstances — may delay or prevent us from fulfilling our obligations. In such cases, we will notify you as soon as reasonably possible and work toward a resolution. Specific consequences and remedies are governed by your Custom Manufacturing and Sale of Goods Contract.

16. Governing Law & Disputes

These Terms are governed by and interpreted in accordance with the laws of the State of Texas, United States. Any disputes arising from your use of this website or these Terms will be resolved in a court of competent jurisdiction.

You and FoodieTrailers each agree to bring any claims only in an individual capacity — not as part of a class action or representative proceeding.

17. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the website following any update constitutes your acceptance of the revised terms.
